These Terms of Use ("Terms") govern your access to and use of the MotionCalm Android application ("the app", "we", "us"). By downloading, installing, or using MotionCalm, you agree to be bound by these Terms. If you do not agree, do not use the app.
MotionCalm is a motion sickness relief application that displays a moving visual overlay ("motion dots") intended to help reduce discomfort caused by motion sickness while traveling. MotionCalm is a wellness aid, not a medical device or treatment, and is not intended to diagnose, treat, cure, or prevent any medical condition.
MotionCalm is not directed at children under the age of 13. By using the app, you represent that you meet this age requirement or are using the app with the consent of a parent or guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use MotionCalm on Android devices you own or control, solely for your personal, non-commercial use, subject to these Terms.
You may not: reverse-engineer, decompile, or disassemble the app; redistribute, resell, or sublicense the app; remove or alter any proprietary notices; or use the app for any unlawful purpose.
MotionCalm offers the following in-app products through Google Play Billing:
All payments are processed by Google Play. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal, via the Google Play Store app on your device (Menu → Subscriptions). We do not process payments directly and do not have access to your payment details.
Refunds are subject to Google Play's refund policy. We do not directly control or guarantee refund approval, as this is handled by Google.
MotionCalm, including its name, logo, design, and underlying code, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you beyond the limited license granted in Section 3.
MotionCalm is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee that the app will eliminate or reduce motion sickness for every user, or that it will be uninterrupted, error-free, or compatible with every device.
If you have a medical condition or are uncertain whether it is safe to use a visual overlay app while traveling, consult a qualified healthcare professional before use.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or related to your use of, or inability to use, the app — including any motion sickness, discomfort, or accident that occurs while the app is in use. Because MotionCalm displays an overlay while your device screen is active, you are solely responsible for using it safely and in compliance with any applicable laws regarding device use while traveling (for example, not using it in a manner that distracts a vehicle's driver).
We may suspend or terminate your access to the app at any time if you violate these Terms. You may stop using the app and uninstall it at any time. Sections 5, 6, 7, and 9 survive any termination.
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of India.
We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated Terms. Material changes will be reflected by updating the date at the top of this page.
